Biopods Inc., this website, and all other Biopods-related trademarks and design marks displayed on this website (collectively, the “Trademarks”) are registered and common law trademarks of their respective owners. Nothing contained on this website should be construed as granting, by implication or otherwise, any license or right to use any trademarks, including the Trademarks, except with the express written permission of Biopods Inc. or such other party that may own the applicable trademarks.

Digital Gift Card Terms of Purchase

1. Issuance and Delivery

Electronic Delivery: Gift cards are delivered solely via electronic mail to the email address provided at checkout.No physical card will be shipped.
Delivery Timing: Gift card codes are typically dispatched immediately after payment authorization. Please allow up to 24 hours for automated fraud screening.
Customer Responsibility: You are solely responsible for ensuring the accuracy of the recipient’s email address. Biopods Inc. is not liable for gift cards delivered to an incorrect, misspelled, or invalid email address supplied by the purchaser.

2. Redemption and Usage Limitations

Eligible Purchases: Gift cards are valid exclusively for the purchase of eligible merchandise online at Biopods.com.
Exclusions: Gift cards cannot be used to purchase additional gift cards, nor can they be exchanged for cash, checks,or credit, except where required by applicable law.
Currency: Gift cards are issued in your location currency and may only be redeemed in that currency. Currency conversion fees or checkout restrictions may apply if purchasing from international storefronts.
Partial Balances: If an order exceeds the available balance on a gift card, the remaining balance must be paid with another accepted payment method. Any unused balance remains associated with the gift card code until depleted.

3. Expiration and Service Fees

No Expiration: Gift cards purchased directly from Biopods.com do not expire.
No Inactivity Fees: No dormancy, maintenance, or service fees of any kind will be assessed against the balance of your gift card.

4. Lost, Stolen, or Misdirected Cards

Treat digital gift card codes like cash. Lost, stolen, forwarded, or unauthorized gift card codes will not be replaced, refunded, or credited unless you provide the original order confirmation and proof that the balance remains unredeemed.
Once a balance has been redeemed by any party, Biopods.com bears no responsibility to reimburse the purchaser or recipient.

5. Fraud and Cancellation

Biopods.com reserves the right to refuse, cancel, or hold for review any gift card order or transaction suspected of being obtained through fraudulent, unlawful, or deceptive means.
If a fraudulently obtained gift card is redeemed, Biopods.com reserves the right to cancel associated product orders or pursue alternative payment.

Use of This Site

This website may not, in whole or in part, be copied, reproduced, republished, uploaded, posted, transmitted or distributed without the written permission of Biopods Inc., except that you may download, display and print the materials presented on this website for your personal, non-commercial use only. Unauthorized use of this website and/or the materials they contain may violate applicable copyright, trademark or other intellectual property laws or other laws. You must retain all copyright and trademark notices, including any other proprietary notices, contained in the materials. The use of such materials on any other website or in any environment of networked computers is prohibited. You are prohibited from contributing, posting or transmitting any infringing, unlawful, threatening, libellous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.

Indemnification

You shall indemnify and save harmless Biopods Inc., its directors, employees, consultants, representatives and agents from and against any claim, cause of action or demand, including without limitation reasonable legal, accounting and other professional fees, brought as a result of your use of this website.

Governing Law

This Agreement and its performance shall be governed by the laws of the Province of Ontario, Canada. You consent and submit to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada., in all disputes arising out of or relating to the use of this website and these Terms and Conditions.

The headings used in these Terms and Conditions are included for convenience only and will not limit or otherwise affect these Terms and Conditions.

Entire Agreement

These Terms and Conditions, together with those incorporated or referred to herein, constitute the entire agreement between us relating to the subject matter hereof, and it supersedes any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter, and may not be amended or modified except in writing, or by Biopods Inc., making such amendments or modifications available to it pursuant to the Terms and Conditions.
